about

What is a Certificate of Residence?

A Certificate of Residence (COR) is the evidence a paying agent or custodian needs to apply a reduced treaty rate of withholding tax on behalf of a nonresident investor. Without a valid COR on file, there’s generally no basis to apply anything other than the statutory rate.

Alongside any other required documentation (such as a beneficial ownership declaration) a valid COR supports either a relief-at-source application or a later reclaim. Sprintax Dividends offers a full suite of DWT relief and recovery solutions, including support with COR preparation.

How does a Certificate of Residence affect DWT?

Without a valid Certificate of Residence on file, a custodian or paying agent generally has no basis to apply anything other than the full statutory withholding tax rate. With a COR in place, alongside any other required documentation, you can support either a relief-at-source application or a later reclaim.

No COR on file

$700 you receive

30% withheld

Full statutory rate applies by default.

COR on file

$850 you receive

15% withheld +$150

Treaty rate applied at source, or reclaimed later.

Illustrative example on a $1,000 gross dividend. Rates vary by treaty.

Key Certificate of Residence documents

There’s no single global standard for a Certificate of Residence.

The name of the document, how you apply for it, how long it remains valid and how long it takes to issue, all differ significantly depending on which tax authority you’re dealing with.

United States

Certification of US tax residency

Form 6166 is a computer-generated letter that certifies US tax residency and unlocks reduced foreign withholding on dividends. A new one is needed for each year you claim.

the process

How do investors apply for a Certificate of Residence?

The route differs by country, but the shape of the process is the same everywhere.

  1. Request the certificate

The investor begins the process by requesting a certificate from the tax authority in their country of residence.

  2. Residency validation

The tax authority checks the request against the investor’s tax-filing history to verify their tax status.

  3. The investor receives the letter

Once satisfied with the verification of the investor’s residency status, the tax office issues the COR to the investor.

  4. Refund application

The investor includes their COR with the application for relief at source, or for a dividend withholding tax refund.

F.A.Q.

Your questions, answered

How long do Certificates of Residence remain valid?
Validity periods vary by issuing country. Keeping yours current and re-applying before it lapses is essential to avoid gaps in your relief-at-source coverage or delays to reclaim eligibility.
What is Form 8802 and why do you need it?
Form 8802 is the application U.S. taxpayers file with the IRS to request Form 6166, the official U.S. certificate of residency. You need this document in order to claim benefits under a U.S. tax treaty abroad.
What is Form 6166 (Certificate of Residency)?
Form 6166 is the actual certificate issued by the IRS after it reviews and approves your Form 8802. It confirms you were a U.S. resident for federal tax purposes for the certification year and is the document you present to a foreign tax authority or payer to support treaty-based relief.
How long does Form 8802 processing take?
The IRS recommends submitting Form 8802 at least 45 days before you need the certificate. Processing typically takes approximately six to 10 weeks, though this can vary depending on IRS workload and how complete your application is. Applying early is the safest way to avoid missing a treaty deadline.
What is a Certificate (Letter) of Residence in Ireland?
A Letter of Residence is the document Irish Revenue issues to confirm someone’s tax residency in Ireland to a foreign tax authority, where Ireland has a Double Taxation Agreement with that country. It’s used specifically to support a claim for exemption or a reduced withholding rate abroad.
How do you apply for a letter of residence from Revenue?
Individuals and businesses can request a Letter of Residence through the ‘Manage My Record’ section of Revenue’s myAccount service, or through ROS.

Before issuing the letter, the relevant Revenue division must be satisfied (based on your tax record) that you were actually resident in Ireland for tax purposes in the year in question. Once validated, the letter becomes available to download through the online service.
How long does it take to get a letter of residence in Ireland?
Revenue doesn’t publish a fixed turnaround time – the letter is only issued once the appropriate division has checked and confirmed your residency status against your tax record for that year. It is advised to apply well ahead of any deadline set by the foreign tax authority requesting it.
What is a UK Certificate of Residence?
A UK Certificate of Residence is a document issued by HMRC confirming that you’re a UK tax resident for the purposes of a specific double taxation agreement, income type and period. It’s the document overseas tax authorities or payers require before applying treaty relief to UK-resident investors’ foreign income.
How do you apply for a HMRC Certificate of Residence?
Individuals can apply online through their HMRC Personal Tax Account (Government Gateway), by e-mail, or – if the other country gives a specific form to certify residence – by post. Companies generally use HMRC’s RES1 online service.

Your application needs to specify the relevant treaty country, the type of income involved and the period the certificate should cover.
How long is a UK Certificate of Residence valid for?
A UK Certificate of Residence is generally valid for one UK tax year only.
